<p>On Tuesday, May 7th, <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=793201">SB 513</a>, by Sen. A.G. Crowe, passed out of the Louisiana House Commerce Committee, completing the third of four steps before hitting the Governor’s desk. Louisiana currently provides tax credits for films produced in our state.  <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=793201">SB 513</a> is a essential piece of legislation, which aims to prohibit the use of state film tax credits for the production of pornographic or obscene motion pictures in Louisiana.</p>
<p><strong>LFFA partnered with the national organization, Morality in Media, to assist Sen. AG Crowe in passing </strong><a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=793201">SB 513</a><strong> in committee today. </strong> Gene Mills, President of Louisiana Family Forum Action (LFFA), remarked: <em>“LFF is proud to stand against the corrosive effect of pornography on our culture and in ensuring that not one penny of Louisiana taxpayer money subsidizes this type of filming.” </em></p>
<p>Morality in Media National Board Member, Margaret Rucks of Lafayette, Louisiana, was on hand in committee to testify in favor of the <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=793201">SB 513</a>. In a letter of support for the bill sent to committee members, Morality in Media President Emeritus, Robert Peters, stated, <em>“It would be bad enough for the State of Louisiana to fund a film that used a minor in a scene that depicts simulated sexually explicit conduct. It would be far worse to fund a film that depicts a minor engaging in actual sexually explicit conduct” </em>(Morality and Media, Article, Robert Peters, Esq., President of Morality and Media, May 6, 2012).</p>
<p>Scientific studies have consistently demonstrated the addictive nature of pornography.  Social scientists can also attest to the broken lives and families left in the destructive wake of pornography&#8217;s addiction. Both Louisiana children and Louisiana taxpayers are beneficiaries of <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=793201">SB 513</a>, which protects each from the pornographic industry&#8217;s exploitative and graphic ways.</p>
<p><a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=793201">SB 513</a> now moves to the Senate Floor for a final vote and then onto the Governors desk for his signature.</p>

<p>Friends,</p>
<p>I had the privilege to join Senate President John Alairo, Senate President Pro Tempore Sharon Broome, Sen. Gerald Long, Representative Walt Leger and others as they challenged and led prayer for state government on the <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://nationaldayofprayer.org/">61st National Day of Prayer</a> hosted in the Senate Chamber. Private First Class Landon Mills joined by praying for America&#8217;s Commander in Chief, our military and their families! The theme this year was <strong>&#8220;One Nation Under God&#8221;</strong> and was focused on Psalm 33:12, <em><strong>&#8220;Blessed is the nation who&#8217;s God is the Lord!&#8221;</strong></em></p>
<p>Prayer continued last night as I joined Pastor Dwayne Bland and the Thibodeaux Ministerial Alliance on the courthouse steps to repent for national and state sins. We entreated Gods favor and blessing as we requested <strong>&#8220;healing for our land.&#8221;</strong> It was a powerful time of prayer!</p>

<p><span style="font-size: 14px;"><em><strong>Sunshine continues to illuminate Louisiana&#8217;s Capitol House&#8230;</strong></em></span><br />

Rick Ward, identifies as a crime <em>“Criminal Unlicensed Abortionist“</em> involving a non-licensed physician in Louisiana performing an abortion.  It passed the Senate 37-0.</p>
<p><img style="width: 15px; height: 15px; border: 0; line-height: 100%; outline: none; text-decoration: none; display: inline;" src="http://gallery.mailchimp.com/20dc9be01946aff7364f31092/images/greencheck.png" alt="" width="15" height="15" align="left" /><a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=797600">HB 867</a> by Rep. Stephen Ortego, a pilot program for the Lafayette area which coordinates <em>“Community Based Health Centers&#8221;</em> in or around public schools. Louisiana Family Forum Action (LFFA) encouraged Rep. Ortego to include safeguards against counseling and referring for abortion and the dispensing of contraception. Rep. Ortego did amend his bill and the House passed HB 867 by a vote of 95-0.</p>
<p><img style="width: 15px; height: 15px; border: 0; line-height: 100%; outline: none; text-decoration: none; display: inline;" src="http://gallery.mailchimp.com/20dc9be01946aff7364f31092/images/greencheck.png" alt="" width="15" height="15" align="left" /><a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=779332">HB 691</a> by Rep. Helena Moreno, and <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=772200">SB 100</a> by Sen. Ed Murray, creates<em> &#8220;preferential treatment&#8221;</em> in state employment based on <em>&#8220;sexual orientation.&#8221;</em>  Both bills were scheduled for committee but were not heard when the authors decided not go forward with their bills.</p>

Rick Ward is an authentic <em>&#8220;Anti-Bullying&#8221;</em> bill which comprehensively and rationally protects all children equally and provides for penalties for bullying.  SB 709 passed out of the Senate Education Committee with no objection. <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://theadvocate.com/home/2740153-125/senate-committee-backs-anti-bullying-bill">Click here</a> to see this Advocate Report.</p>

Dorsey-Colomb, a politically charged bullying bill not supported by LFFA because of important constitutional concerns. It was involuntarily deferred in the Senate Education Committee by a 4-1 vote.</p>

<p>If <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=788644">Senate Bill 708</a> by Sen. Sharon Weston Broome, D &#8211; Baton Rouge, becomes law, every pregnant woman pursuing an abortion must be instructed of the medical facts of her child’s life and must hear the narrative detail of the ultrasound. Most importantly, <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=788644">SB 708</a> offers every mom the live sound of her child’s heartbeat during the ultrasound.</p>
<p>SB 708 is scheduled to be heard in the Senate Health &amp; Welfare committee tomorrow, April 18th at 9:00 AM .  We applaud Sen. Broome for her outstanding work and courage in sponsoring this bill!</p>
<p><strong>If this bill becomes law, it will foster irrefutable evidence for life.</strong> For a Louisiana mom considering abortion, it would be undeniable to hear her child’s heartbeat and remain unaware of the life within her.</p>

This year the event is occurring in public schools across the nation on <strong>Thursday, April 19.</strong></p>
<p>This is a wonderful opportunity for students who feel God’s leading to articulate a loving and Christ-centered response to hot-button topics like bullying, sexuality and gender identity already being discussed on their school campuses. <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.dayofdialogue.com/"><strong>The Day of Dialogue</strong></a> gives a student, the opportunity to express the true model presented by Jesus Christ in the Bible.  His example calls us to stand up for those being harmed or bullied while offering the light of what God’s Word says.</p>

<p>The U.S. Senate could vote soon on the gimmicky distraction known as the <em>Buffett Rule</em> — President Obama’s plan to raise taxes on wealthy Americans and job creators in order to supposedly bring <em>“fairness”</em> to the tax code and pay down the debt.  The facts of the Buffett Rule are simple; the President wants millionaires (and small businesses taxed as individuals) to pay a minimum tax of 30 percent. To put things into perspective, President Obama’s budget calls for adding $6.7 trillion to the national debt, so the Buffett Rule would cover just 0.7 percent of all of Obama’s debt and .1 percent of Obama’s spending.</p>
<p>To make matters worse, American taxpayers face an even bigger burden coming on January 1, 2013, unless Washington takes action. On that day, an unprecedented $494 billion tax hike known as “<a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://blog.heritage.org/2012/04/05/morning-bell-beware-the-taxmageddon/">Taxmageddon</a>” will descend on the United States.  What our nation needs are serious solutions to our spending and debt crisis, and policies that really do create jobs. <p>On Friday, April 20, the Gay, Lesbian, Straight Education Network (GLSEN) will encourage students to remain silent for an entire school day in solidarity with the radical lesbian, gay, bisexual, transgender (LGBT) agenda.</p>

<p>The Resurrection Holiday slowed the pace at the Louisiana Capitol this week. Key Louisiana Family Forum Action (LFFA) legislation is winding through the process.  Yesterday <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=790160">SB 435</a>, by Sen. Sharon Weston Broome (D-Baton Rouge), passed the Senate 38-0 with 17 co-authors, requiring the posting of Human Trafficking Hotline in all Louisiana sexually-oriented businesses.</p>
<p><a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=788358">SB 256</a>,  by Sen. Danny Martiny (R-Metairie),  also known as &#8220;The Safe Pregnancy for Women Prisoners&#8221; bill, also passed the Senate unanimously and is set for floor debate in the House on April 17th. It prohibits shackling of female prisoners during labor and delivery.</p>
<p>HB 1086, by Rep. Seabaugh (R-Shreveport), deals with euthanasia and the general medical consent statute and will be heard in the House Health and Welfare Committee tomorrow.</p>

<p>Gulf of Mexico oil drillers will be busier this year than at any point since the BP oil spill of 2010!  Eight more deepwater rigs are expected in the Gulf this year, based on what oil companies tell contractors. &#8220;Our customers still see the Gulf of Mexico as an attractive place to do business,&#8221; says Steven Newman, head of Transocean, the world&#8217;s largest rig contractor.</p>
<p>Greater New Orleans Inc. says an average of three permits a month were approved in the November to January period, compared with nearly six per month in the year before the spill. <p>The Resurrection of Jesus Christ is the foundation of Christian Orthodoxy and the central event that distinguishes Christianity from all other faiths. <strong>&#8220;Life&#8221;</strong> arising miraculously, supernaturally and redemptively brings great hope. I concur with the former German Chancellor that, <strong><em>&#8220;Outside of the resurrection, I know of no other hope for mankind.&#8221;</em></strong></p>

Mills into our family. Our first grandchild and the first child of Theo &amp; Katy Mills has rocked my world! I was duly warned and knew in my head that <em>&#8220;change&#8221;</em> was coming. I had no idea how hard it would strike my heart or how sustained the <em>&#8220;longing&#8221;</em> would be to hold our precious gift.  I see more clearly now that He&#8217;s washed my eyes with tears of joy. I beheld His miracle, witnessed His image and sensed His presence and protective care all over little Annaliese!<strong> Holy Week began for me&#8230; off the chart!</strong></p>
<p><img style="width: 165px; height: 221px; margin: 3px 5px; border: 0; line-height: 100%; outline: none; text-decoration: none; display: inline;" src="http://gallery.mailchimp.com/20dc9be01946aff7364f31092/images/AnnalieseMills6.JPG" alt="" align="right" />I was quickly struck by another reality; that <strong>traditional values are no longer unassailable in Louisiana but remain under constant assault.</strong> Those opposed to a biblical worldview are working overtime to discredit the efforts of Christians who <strong>“dare”</strong> to stand for truth and righteousness at the Capitol.  <strong>Thank God we serve a risen Savior who does not sleep and is involved in the affairs of men! </strong>  Please pray for strength and protection for your team, working overtime as Watch Men on the <strong>wall of government</strong> in Louisiana.</p>
<p>I also witnessed that <em>&#8220;truth&#8221;</em>, no matter how carefully communicated, unleashes angry, <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://theadvocate.com/news/opinion/2481695-123/inside-report-for-april-4">inaccurate and combative forces</a>. <p>The fall of Adam and Eve left this world a harsh place, and gave birth to this world&#8217;s spiritual poverty. The suffering caused by mankind&#8217;s fall reminds us that brokenness is everywhere! Indeed, Christ didn&#8217;t die on the cross for a world that didn&#8217;t need Him. He died for one that did and does, not just humanity, but I need Him!<img style="width: 300px; height: 225px; margin: 3px 3px 5px 5px; border: 0; line-height: 100%; outline: none; text-decoration: none; display: inline;" src="http://gallery.mailchimp.com/20dc9be01946aff7364f31092/images/HeIsRisen.1.png" alt="" width="300" height="225" align="left" /></p>
<p>That&#8217;s where the Resurrection of Christ brings the greatest hope! It&#8217;s not Louisiana&#8217;s political leaders, though we must always strive to elect statesmen and pray for their time in office. Our hope is not in political solutions, though we must always advocate for the right principles. Our hope is in the renewal that one day <em>&#8220;the government will be upon His shoulders&#8221;</em> as promised. Our hope will not depend upon each election because this world will be renewed and restored to its original state. Our ultimate hope is in Him, and for that we are truly thankful and in hope, we look forward to the day when all things are made new.</p>

<p>Supreme Court oral arguments on the Affordable Care Act began Monday.  We can expect a decision either in June or October.  What will it be?  Constitutional or un-constitutional?</p>
<p>The Court faces five main arguments:  <strong>(1)</strong> The case is premature: either no one has standing or the Anti-injunction Act (AIA) precludes it,  <strong>(2)</strong> the Mandate violates the Commerce Clause (CC), <strong>(3)</strong> the Act violates the 10th Amendment in general or through Medicaid issues, <strong>(4)</strong> the Penalty violates the taxing power or <strong>(5)</strong> the Penalty enforcement facially denies due process.</p>

<p>March 26, 2012</p>
<p>Dr. Perry Sanders, longtime pastor of First Baptist, Lafayette, passed away Monday, March 26, 2012, in Colorado Springs, Colorado, at 2 a.m. local time.  He was 84 years old. Sanders served First Baptist for 47 years before retiring in 2006.  He previously served churches in other Louisiana cities including Baton Rouge and Jennings.</p>
<p>Born in South Carolina, he came to Louisiana to attend New Orleans Baptist Theological Seminary.  In addition to his service to local churches, he served two terms as president of the Louisiana Baptist Convention, also terms as Pastoral Advisor to the Louisiana Baptist Student Union and Louisiana Baptist Music Conference, both the Foreign and Home Mission Boards of the Southern Baptist Convention, and chaired the Southern Baptist Convention Committee on Committees.  <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.thechurchreport.com/index.cfm?fuseaction=siteContent.default&amp;objectID=151532#.T3G_71-7V24.email">Click here to read Dr. Sanders story</a></p>

<p>On just 390 screens, October Baby was the Number Eight movie overall, the Number One independent release and the Number Three in &#8220;per-screen&#8221; average. Its positive effect on thousands of lives are <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="https://www.facebook.com/OctoberBabyMovie?sk=wall">echoed on their Facebook page</a>!   October Baby was up against one of Hollywood’s biggest hits of the year on 4,000 screens and still did well.  It is still in theaters!  Go see the movie and send a message to Hollywood that we believe<strong> “Every Life is Beautiful.” </strong></p>

<p>On behalf of parents and children across Louisiana, I want to especially thank these Representatives (<a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=784080">you can view support and opposition here</a>) for voting in favor of <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=782437">Parental-Choice in Education and a Parental-Trigger</a> for failing public schools and providing hope for the neediest amongst us!</p>
<p><a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.legis.state.la.us/billdata/streamdocument.asp?did=782453">House Bill 974</a> (tenure reform) also passed just before 1:00 a.m. this morning.  The vote was 64-40-1. <p style="text-align: left;">Magellan Strategies BR today released the survey that finds former U.S. <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://thehayride.com/2012/03/breaking-santorum-in-double-digit-lead-in-louisiana-says-poll/">Senator Rick Santorum leading his closest opponent</a> by thirteen points in Louisiana. Santorum’s strong image (72% favorable/20% unfavorable) and relatively few undecided voters (6%) puts him in a strong position to win a plurality in the Louisiana GOP Primary.</p>
<p>Though currently running second, Romney’s struggling image could potentially hinder any growth potential.</p>

<p><a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://thehayride.com/2012/03/15-minutes-with-newt-gingrich/">When interviewed Friday</a>, Gingrich agreed that a strong finish in Louisiana was crucial. Third place won’t cut it for his strategy of sticking around to the Texas primary.  With Louisiana taking on more primary significance this year than in any recent cycle, if Magellan’s poll numbers hold up a major boost to Santorum’s campaign is coming this Saturday.</p>

<p>The U.S. Supreme Court on Monday turned down Louisiana’s bid to recover the congressional seat taken from the state as a result of the 2010 Census.  <strong>The lawsuit, filed by Louisiana Attorney General Buddy Caldwell, asked the court to order the federal government to re-calculate House seats based only on legal residents.</strong></p>
<p>Caldwell issued a statement saying he was disappointed in the Supreme Court’s ruling, arguing the Census procedure “dilutes the rights of American citizens.”  “By turning a blind eye to the issue presented, the court has elevated the benefits of illegal immigration by foreign nationals to another level,” he said.  <a style="color: #336699; font-weight: normal; text-decoration: underline;" href="http://www.washingtonpost.com/politics/congress/supreme-court-turns-away-louisiana-bid-to-recover-congressional-seat-lost-to-census/2012/03/19/gIQApMcjNS_story.html">Read the full report here</a>.</p>

<p>The Obama administration is not backing down from its anti-conscience mandate but hopes to bury the controversy with bureaucratic delay. In its <strong><em>“Advanced Notice of Proposed Rulemaking,”</em></strong> the government now officially promises to take action at some time in the future to address the conflict.</p>
<p>The March <strong>“notice”</strong> about February’s<strong> “accommodation”</strong> to January’s <strong>“final rule”</strong> also is an admission that the administration still has no idea who should be forced to pay for its mandate.  The <strong>&#8220;notice&#8221;</strong> would <strong><em>still require religious organizations to make sure all of their employees have access to the offending coverage.</em></strong></p>
<p>The <strong>&#8220;notice&#8221;</strong> admits that the government is trying to figure out how to define religious ministries when it asks: <strong><em>“What entities should be eligible for the new accommodation (that is, what is a ‘religious organization’)?”</em></strong>  <strong>Friday’s announcement changes nothing</strong>. The administration clearly is not backing down from its original plan.</p>

<p style="padding-left: 30px;">On a per student basis, roughly one-third of students—or 235,000—statewide &#8220;lack the grade-level knowledge and skills to succeed academically&#8221; and half of students in our three largest cities, Shreveport, New Orleans and Baton Rouge.</p>

<p><strong><span style="text-decoration: underline;">LOUISIANA IS IN THE BOTTOM FIVE STATES NATIONALLY</span></strong></p>
<p><a href="http://www.lafamilyforum.org/wp-content/uploads/2012/03/4thGradeReading-Math.png"><img class="aligncenter size-full wp-image-1218" title="4thGradeReading-Math" src="http://www.lafamilyforum.org/wp-content/uploads/2012/03/4thGradeReading-Math.png" alt="" width="438" height="232" /></a></p>
<p style="padding-left: 30px;">Louisiana&#8217;s standards are relatively low when compared nationally. While 71% of students are proficient in 4th grade reading by Louisiana standards, only 18% are proficient by national standards on the National Assessment of Educational Progress (NAEP).</p>
<p style="padding-left: 30px;">While 64% of students are proficient in 4th grade math by Louisiana standards, only 23% are proficient by national standards (NAEP).</p>
<p style="padding-left: 30px;">According to the 2012 &#8220;Quality Counts&#8221; report, Louisiana was ranked 48th with an F for &#8220;student achievement&#8221; and 46th with a C- for a student&#8217;s &#8220;chance for success.&#8221;</p>
<p style="padding-left: 30px;">Louisiana ranks 41st for student scores on the ACT with only two districts in the entire state scoring above the national average. Louisiana ranks 10th in the south for student scores on the ACT.</p>
<p style="padding-left: 30px;">Louisiana&#8217;s graduation rate is 70.9%, which means that nearly 30% of our students are still not making it to a high school diploma on time. The national graduation rate is 71.7%.</p>

<p><span style="text-decoration: underline;"><strong>M</strong><strong>ONEY IS NOT THE ISSUE</strong></span></p>
<p style="padding-left: 30px;">Between Fiscal Year 2008 and today, <strong> <span style="text-decoration: underline;">the state has increased funding to K-12 education</span></strong>—through the state formula, or MFP—by <strong><span style="text-decoration: underline;">$289 million or 9.3%.</span> </strong>Meanwhile, the state&#8217;s budget as a whole has decreased by 26%.</p>
<p style="padding-left: 30px;">If 44% of schools are receiving a D or F and the state pays on average 65% of the MFP, annually we are spending nearly $1 billion per year on failing schools.</p>
<p style="padding-left: 30px;">Districts on average spend 7% of per pupil spending on central office overhead.</p>
<p style="padding-left: 30px;">Nationally, Louisiana ranks 22nd for school finances but 48th for student achievement according to the 2012 &#8220;Quality Counts&#8221; report.</p>
<p><span style="text-decoration: underline;"><strong>WE&#8217;VE SPENT ENOUGH TIME</strong></span></p>
<p style="padding-left: 30px;">Louisiana&#8217;s average score in fourth grade reading has increased <span style="text-decoration: underline;">by just three points since 1992</span>. Since 2005, Louisiana&#8217;s average ACT score has increased by <span style="text-decoration: underline;">only four-tenths of a point</span>, from 19.8 in 2005 to 20.2 in 2011.</p>

<h3 style="text-align: center;"><strong><span style="text-decoration: underline;">Governor Jindal&#8217;s Reform Plan Empowers Teachers and School Leaders </span></strong></h3>
<p>&nbsp;</p>
<p><span style="text-decoration: underline;"><strong>THE SITUATION</strong></span></p>
<p style="padding-left: 30px;">All teachers are treated the same by the system regardless of performance.</p>
<p style="padding-left: 30px;">Superintendents and principals are disempowered to actually manage their school buildings.</p>
<p style="padding-left: 30px;">Districts are burdened with red tape and bureaucracy that takes time and money away from the classroom. Tenure is awarded automatically after three years in the classroom with little to no performance review; 99% of teachers receive satisfactory evaluations under this system.</p>
<p style="padding-left: 30px;">In 2010, Louisiana created a &#8220;value-added&#8221; evaluation system for teachers, principals, and superintendents that compares how much a student knew at the end of the year versus the beginning of the year, putting all teachers on a level playing field.</p>
<blockquote>
<ul>
<li>The state board of education created three designations based on the new evaluation system: highly effective (top 10%), effective (middle 80%) and ineffective (bottom 10%).</li>
</ul>
<ul>
<li>Based on these ratings, after two years of being rated ineffective, districts must start dismissal proceedings; after three years, certification is removed by the state.</li>
</ul>
</blockquote>
<p><span style="text-decoration: underline;"><strong>HB 974 by Representative Carter and SB 603 by Senator Appel empower effective teachers, support</strong><strong> ineffective teachers who want to improve, and rethink district management to prioritize kids, not adults.</strong></span></p>

<p><span style="text-decoration: underline;"><strong>THE SITUATION</strong></span></p>
<p>We have many types of educational options today in Louisiana: traditional public schools, charter public schools, private schools, virtual education, higher education dual enrollment, and business and industry coursework.</p>
<p>These choices are funded separately and <span style="text-decoration: underline;">often on top</span> of the $3.31 billion going to K-12 education through the MFP. The system doesn&#8217;t leverage dollars effectively or make it easy for parents to take advantage of all the options.</p>
<p>Parents can&#8217;t choose a better school. They have three unacceptable options: they can move, they can vote, or they can pay for private school.</p>
<p>The MFP is a weighted per pupil formula where low income and special education students, for example, receive additional dollars. Once those dollars leave Baton Rouge, however, there is little way to know that they have been spent on the students for whom they were allocated and no consequences when they are not.</p>
<p>With 44% of schools rated D or F, far too many students are stuck in failing schools today.</p>
<p>&nbsp;</p>
<p><strong><span style="text-decoration: underline;"><a id="anchor5" name="anchor1"></a>HB 976 by Representative Carter and SB 597 by Senator Appel expand choices and empower parents in F</span></strong><strong><span style="text-decoration: underline;">OUR key ways.</span></strong></p>
<p>1. <span style="text-decoration: underline;"> Parent Trigger—Parents should have more levers to affect change</span>.<strong></strong></p>
<p style="padding-left: 30px;"><strong>CURRENT LAW.</strong> A school becomes eligible for state intervention by the Recovery School District after <span style="text-decoration: underline;">four</span> years of failing. An F grade today means that <span style="text-decoration: underline;">at least two-thirds of students are below grade level</span>.<strong><br />
</strong></p>
<p style="padding-left: 30px;"><strong>OUR PROPOSAL. </strong>A school could become eligible for RSD intervention after <span style="text-decoration: underline;">three</span> years of failing if at least 51% of parents at the school sign a petition to do so.</p>
<blockquote>
<ul>
<li>The school&#8217;s status would still be reviewed by BESE before it was transferred to the RSD.</li>
</ul>
</blockquote>
<p>2.   <span style="text-decoration: underline;"> Supporting High Quality Charter Schools—High quality charter schools should be supported</span>.<strong></strong></p>
<p style="padding-left: 30px;"><strong>CURRENT LAW.</strong> There is only one way to become a charter school; application processes vary from parish to parish to BESE; timelines for applications overlap; and high quality applicants have to apply one school at a time, pushing paper and process rather than being awarded for success.<strong></strong></p>
<p style="padding-left: 30px;"><strong>OUR PROPOSAL.</strong> Creates <span style="text-decoration: underline;">three additional pathways</span> to becoming a charter school and streamlines and improves the charter application process for all charter authorizers.</p>
<blockquote>
<ul>
<li>It creates a new Type 1B charter authorizer, which could be a philanthropy, policy nonprofit, university, or nonprofit board started by a municipal or parish government, which applied to receive the authority from BESE to authorize <em>local </em>charter schools. It holds the authorizer accountable if the schools they authorize are rated C or lower after 3 years. These schools would be held to the same standards as other charter schools by BESE, including administering state tests.</li>
</ul>
<ul>
<li>It allows applicants in districts receiving a D or F to apply directly to BESE as a Type 2.</li>
</ul>
<ul>
<li>It provides that applicants in districts without charter application processes or that have repeatedly failed to comply with charter law to apply directly to BESE as a Type 2.</li>
</ul>
<ul>
<li>It creates a common charter application and streamlines application procedures for school boards <em>and</em> BESE, creating a more seamless process for Type 1, 1B, 2, 3, and 4 applications.</li>
</ul>
<ul>
<li>It instructs BESE to actively recruit charter operators with a technical, vocational, or career focus, to ensure that every child has an option that meets their needs.</li>
</ul>
<ul>
<li>It provides for BESE to create a process for charter operators with demonstrated track records of success.</li>
</ul>
<ul>
<li>It shortens the contract period for BESE approved charter schools from 5 to 4 years, ensuring that charters are held accountable for results. BESE would still conduct a rigorous review after 3 years.</li>
</ul>
</blockquote>
</div>

<p style="padding-left: 30px;">3. <span style="text-decoration: underline;">Course Providers—Students should have access to more courses regardless of zip code</span>.</p>
<p style="padding-left: 60px;"><strong>CURRENT LAW. </strong>Students are generally funded on a per pupil basis to attend one school full time. If the school they attend does not have the courses they need or want, such as Advanced Placement courses, credit recovery, career and technical education courses, or access to dual enrollment with postsecondary education, the student doesn&#8217;t have many options for accessing these courses.</p>

<ul>
<li>There are a small number of course providers in Louisiana: the Louisiana Virtual School, a program run by DOE, provides virtual education to schools across the state; postsecondary institutions offer dual enrollment in academic credit granting and career and technical education courses. These programs are funded <span style="text-decoration: underline;">on top of</span> the MFP and access has been restricted by limited dollars.</li>
</ul>
</blockquote>
</blockquote>
<p style="padding-left: 60px;"><strong>OUR PROPOSAL. </strong>Creates a new type of entity that can offer individual courses to students. All students at public and private schools have access to these courses, but only certain students are funded.</p>
<blockquote>
<blockquote>
<ul>
<li><span style="text-decoration: underline;"><a id="anchor3" name="anchor3"></a>F</span><span style="text-decoration: underline;">unded students</span> include students who attend a public school a) receiving a C, D, or F; or b) where the course is not offered; OR is c) a BESE approved home study program; or d) is a BESE approved nonpublic school participating in the Scholarship Program.</li>
<ul>
<li>These students would have their MFP dollars follow them to the course provider of their choice and the credit they earned would translate back to the school at which they are currently enrolled.</li>
</ul>
<li><span style="text-decoration: underline;">P</span><span style="text-decoration: underline;">a</span><span style="text-decoration: underline;">rticipating students</span> include students who attend a school a) receiving an A or B where the course is already offered; b) is a BESE approved nonpublic school.</li>
<ul>
<li>These students could pay the same price charged to funded students to participate in the course.</li>
<li>Course providers would be held to the same accountability provisions as public schools. They would be reviewed every three years by BESE and their courses would have to be approved as granting credit for one of Louisiana&#8217;s diplomas. Applicable enrolled students would still take state tests.</li>
<li>Course providers would be paid for performance—50% when a student enrolls and 50% when a student completes the course.</li>
<li>School districts where the enrolled student is full time would receive 10% of the MFP off the top to cover sunk costs.</li>

<p>4. <span style="text-decoration: underline;">Expanding the Scholarship Program—Students should have more choices now. We can&#8217;t wait.</span><strong></strong></p>
<p style="padding-left: 60px;"><strong>CURRENT LAW. </strong>Only students who reside in Orleans Parish, whose parents make up to 250% of Federal Poverty, and attend a failing school may participate in the Scholarship Program. Non-failing public and private schools may receive these students and the students must take state tests.</p>
<p style="padding-left: 60px;"><strong>OUR PROPOSAL. </strong>Expands access to the Scholarship Program to students in C, D, and F schools or who are entering Kindergarten statewide whose parents make up to 250% of Federal Poverty. <span style="text-decoration: underline;">C schools have up to one third of students below grade level.</span></p>

<li>Participating students would still have to take state tests and these results would be reported back to the state and to the parents of participating students.</li>
</ul>
<ul>
<li>Participating private schools would have to be approved BESE nonpublic schools and<span style="text-decoration: underline;">meeting the nondiscriminatory criteria of <em>Brumfield v. Dodd</em>.</span> Registered nonpublic schools are not eligible.</li>
<li>Participating public schools would have to be receiving an A or a B and have opted to participate in the program. Principals would choose whether to participate, with the approval of the superintendent, but the superintendent could not force a principal to participate. No public school will be forced to accept scholarship students.</li>
<li><span style="text-decoration: underline;">All participating schools would be subject to a third party audit to ensure that there are no fraudulen</span><span style="text-decoration: underline;">t schools or diploma mills participating in the program</span>. Schools that fail to comply or have audit findings would be frozen in the program for one year. Failure to improve would result in being removed from the program.</li>
<li>Students would be placed in schools by random lottery; <span style="text-decoration: underline;">students would not be cherry picked </span><span style="text-decoration: underline;">or selectively chosen</span>.</li>
<li>Participating schools will receive the full weighted MFP amount for the parish in which the student resides or, if they charge tuition, an amount equal to actual tuition, whichever is lower.</li>
<li>Private schools that meet special education criteria equivalency to the federal Individuals with Disabilities Education Act (IDEA) may offer special education services to scholarship students and charge an additional special education tuition amount up to the maximum MFP amount for that parish.</li>

<p><span style="text-decoration: underline;"><strong><a id="anchor4" name="anchor3"></a>HB 969 by Representative Talbot creates a dollar for dollar rebate for donations made to designated non profit &#8220;school tuition organizations&#8221; that grant scholarships to low income students to attend</strong></span><strong><span style="text-decoration: underline;"> nonpublic schools</span>.</strong></p>
<p style="padding-left: 60px;"><strong>CURRENT LAW. </strong>Individuals that make donations to any nonprofit may receive a tax deduction for their donation, but there is no specific incentive for organizations that grant scholarships for students to attend nonpublic school.</p>
<p style="padding-left: 60px;"><strong>OUR PROPOSAL. </strong>Creates a dollar for dollar rebate for individual or corporate donations to a new designation of nonprofit, a &#8220;school tuition organization&#8221; or STO, to be expended on scholarships for students whose parents make up to 250% of Federal Poverty to attend a nonpublic school.</p>

<li>STOs would have to spend 95% of the donations they receive on scholarships, assigning only 5% for administrative costs. They can only carry forward 25% of donations each fiscal year, ensuring that dollars are expended in a timely manner.</li>
<li>Scholarships would be equal to 80% of the state average portion of the MFP for students in K-8 and 90% for students in 9-12. Students who receive these scholarships would take state tests and these results would be reported.</li>
<li>STOs would notify the Department of Education (DOE) within 30 days of expending any donation on a scholarship; DOE would send a receipt to the donor that may be used to access a rebate from the Department of Revenue (LDR). This ensures that rebates are tied to scholarships actually being allocated and the proposal remains <span style="text-decoration: underline;">cost neutral</span> to the state. As a result, there is no cap on the amount of donations or rebates that may be made in any given year.</li>
<li>STOs would submit an audit of their expenditures to DOE and LDR to ensure that dollars are being spent appropriately. This ensures that <span style="text-decoration: underline;">no fraudulent organizations</span> are abusing the rebate.</li>
<li>Nonpublic schools that are BESE approved and compliant with the nondiscriminatory criteria of <em>Brumfield v. Dodd </em>would be eligible to accept students on scholarships paid for by donations that qualify for a rebate. Schools that receive more than $50,000 per year in scholarships would obtain a surety bond to insure the value of the scholarships.</li>
<li>Donors who receive a rebate would still be able to get a federal tax deduction on their donation, but they would not be able to receive both the rebate and a deduction against their Louisiana state taxes. This prevents &#8220;double-dipping,&#8221; or rewarding donors twice for the same donation.</li>

<p><span style="text-decoration: underline;"><strong>THE SITUATION</strong></span></p>

<li>There are many full time and part time early childhood educational and health programs that receive a total of $1.4 billion in state and federal funds per year plus an additional $150 million for Head Start.</li>
<li>The system is regulatory and focused on inputs, making it difficult for early childhood providers—public and private—to navigate.</li>
<li>There is no measure of quality that gives parents actionable information, such as a letter grade, on which to make a decision about where to send their child.</li>
<li>The taxpayer has no accountability for the dollars it spends on early childhood programs.</li>
</ul>
</blockquote>
<p><span style="text-decoration: underline;"><strong>HB 933 by Representative Carter and SB 581 by Senator Appel create a coordinated early childhood system framework focused on Kindergarten readiness.</strong></span></p>
<p style="padding-left: 30px;"><strong>OUR PROPOSAL. </strong>Instructs BESE to create a coordinated early childhood system by July 1, 2013 by doing four things:</p>
<blockquote>
<ul>
<li>Establishing a definition of Kindergarten readiness and setting performance targets for children ages 0-2 and academic standards for children ages 3-4 based on Kindergarten readiness and aligned to the Common Core Standards for K-12.</li>
<li>Creating a uniform assessment and accountability system for publicly funded programs that includes letter grades as clear actionable information for parents.</li>
<li>Coordinating with DCFS and DHH to align licensing standards for childcares—specifically those receiving public funds (Class A)—and the Tiered Quality Improvement Rating System with this new accountability system. This will streamline and reduce red tape for providers so that dollars flow more easily and the system is easier to navigate according to a set of aligned program standards.</li>
<li>Includes Head Start programs, which would have to participate in this new system and improve the quality of their programs as a condition of their licensing.</li>
<li>Publicly funded programs that are primarily funded with public funds are targeted to be included; this does not include, for example, programs that are only receiving food assistance. However, it does include state and federal funding.</li>
<li>BESE&#8217;s plan will be presented to the Early Learning Advisory Council by the end of 2012 for review and comment. This will allow stakeholders from all areas of early childhood education and childcare to review and participate in the process.</li>
<li>BESE&#8217;s plan will have a full implementation date of 2015-2016 so that programs have time to implement the new standards and shift their focus to Kindergarten readiness.</li>
</ul>

<p>The plan sets broad parameters for what this coordinated Kindergarten readiness system would look like.  It does not flesh out all the details, prescribe specific elements, or name programs that would be affected. BESE will evaluate all of these components in the process, and stakeholders will be able to weigh in.</p>
